dc.descriptionEl presente trabajo se realiza en el marco de una beca CIN-UNLP, cuyo propósito consiste en indagar, dentro del ámbito del Derecho, los posibles cruces entre el principio de autonomía progresiva que se le atribuye al niño en desarrollo y la nueva legislación civil y comercial de la Nación Argentina, especialmente en lo referido a las posibilidades de brindar Consentimiento Informado para ser sujeto partícipe de investigaciones. Presenta como objetivo analizar el nuevo sistema de “capacidades progresivas” a través del cual se van adquiriendo de forma gradual las posibilidades del ejercicio de los derechos y la autonomía para tomar decisiones. Esto se expresa en los Artículos 22 al 50 del nuevo Código Civil y Comercial de la Nación (Ley 26.994, HCNA, 2014), especificando en qué casos los niños pueden realizar el acto de consentir o asentir por sí mismos, acompañado del consentimiento y asentimiento de uno de los progenitores y/o de ambos. Se propone un estudio teórico de revisión y actualización bibliográfica mediante la metodología de análisis de contenido cualitativo (construcción y puesta a prueba de categorías para el análisis y comparación de documentos). En función de las fuentes analizadas, se presentan los resultados y conclusiones establecidas hasta el momento.
dc.descriptionThe present work is carried out within the framework of a CIN-UNLP scholarship, which purpose is to investigate, within the scope of the law, possible relationships between the principle of progressive autonomy attributed to the developing child and the new Civil and Commercial Argentine legislation, especially in relation to the possibilities of providing Informed Consent to be a participant in research. It aims to analyze the new system of “progressive capacities” through which the possibilities of exercising rights and autonomy to make decisions are gradually acquired. This is expressed in Articles 22 to 50 of the new Civil and Commercial Code of the Nation (Law 26,994, HCNA, 2014), specifying in which cases children may perform the act of consenting or assenting by themselves, accompanied by consent and assent of one of the parents and / or both. A theoretical study of bibliographic review and updating is proposed through the methodology of qualitative content analysis (construction and testing of categories for the analysis and comparison of documents). Based on the sources analyzed, the results and conclusions established so far are presented.
