Resumen
This article reviews the interpretation made by the Supreme Court of Justice of the Nation upon the concept of unusual punishment, indicated in the text of Article 22 of the Mexican Political Constitution. The study takes into account the jurisprudence of the US Supreme Court, on the prohibition of cruel and unusual punishment, in the VIII Amendment to the Constitution of the United States. The article indicates that Mexican jurisprudence has doubted when delimiting the scope of the expression, to determine whether or not the concept includes life imprisonment. It has concluded that the current criterion needs to be reviewed in accordance with the principles established by the 2011 constitutional reform on human rights. El artículo revisa la interpretación que la Suprema Corte de Justicia de la Nación ha realizado del concepto de “pena inusitada” señalado en el texto del artículo 22 de la Constitución Política mexicana. El estudio tiene en cuenta la jurisprudencia de la Suprema Corte estadunidense sobre la prohibición de todo castigo cruel e inusual prevista en la VIII Enmienda a la Constitución de los Estados Unidos. El artículo muestra que la jurisprudencia mexicana ha mostrado dudas al delimitar el alcance de la expresión, para determinar si el concepto incluye o no a la prisión vitalicia. Se concluye que el criterio vigente requiere ser revisado, de acuerdo con los principios establecidos por la reforma constitucional en materia de derechos humanos de 2011.
