Abstract

In Colombia, the contracting processes have been an important point of departure for the legal field to present answers and supports to maintain the legality of the state and its actions, which is why, over the years, new legal supports have been generated that allow a guide to ensure the proper development of this process, as well as the penalties that can be incurred by not complying. This article presents research on the regulations that exist in Colombia to mitigate the phenomenon of corruption within the state contracting processes and the way in which these regulations are being functional and beneficial for this. The above, considering a qualitative methodology that allows establishing the regulatory gaps and disciplinary responses that are being given due to legal updates in the country since Law 80 of 1993 to Law 1474 of 2011. Similarly, data collection Will be considered by tracking authors who can support the research and thus determine whether these laws are truly tolos to reduce corruption.
