The study presented below aims to show the development and scope of the concept regarding smart cities in the framework of public policies oriented to urban planning, starting from a study of comparative law between the legislations of Brazil and
Colombia, this under the premise that internet access is a fundamental right of an unnamed nature in light of Colombian Constitutional Law, which has been developed
through regulations; while in the case of Brazil, the aforementioned fundamental right is of a nominated nature with a constitutional basis and legislative developments, this, in the face of public policies through which cities are given meaning, this implies the problem question of research regarding whether regulatory designs in both Colombia and Brazil can provide an appropriate response to the need to develop smart cities?
This in the understanding that in both countries measures have been taken so that the population has access to fundamental rights in urban areas, based on the above, it is intended to determine the similarities and differences with respect to the
treatment of fundamental rights from the explicit mandates derived from its regulations and thus Analyze whether the legal regulations through which cities in Colombia and Brazil are developed present a structure that allows them to develop
the concept of smart cities, or if, on the contrary, they are insufficient. For which the legal norms applicable to the development of cities in Colombia and Brazil must be entered and thus Compare the normative developments of Colombia and Brazil in
order to establish virtues and elements to improve of each order for in a final stage Conceptualize on the challenges and opportunities of territorial planning in Colombia and Brazil in the face of industry 4.0.
