Abstract

False accusations and recantation in sexual crimes turns out to be a complex phenomenon and its causes and prevalence in judicial contexts are still unknown. The aim of the study was to identify the circumstances related to the false accusations and their subsequent recantation in sexual crimes. A qualitative methodology with a hermeneutic approach was used for the study of seven cases that privileged content analysis through the development of category trees. There is a motivational process among the false accusation and the recantation, obeying internal sources (affection, needs, cognitions, discomfort, maturity) and external (stressful events, consequences), as well as relational factors (microsystems, exosystems and macrosystems). It was also possible to identify the fabrication process of the speech of the alleged facts in the statement within the false accusations related to manipulation by a third-person as well as at the volition of the complainant
