La ineficacia de la Ley 28190 a los 16 años de su vigencia: una mirada a la comunidad autogestionaria de Huaycan periodo 2015

La mendicidad infantil se está dando con mayor fuerza en nuestro país ya que la economía está decayendo demasiado rápido y la estabilidad económica es muy baja esto contribuye a que los padres manden a trabajar a sus hijos y así pidiéndoles que lleven dinero a la casa de lo contrario sino lo llevan los amenazan o incluso los obligan a que duerman en la calle. Estos niños, niñas y adolescentes que trabajan están expuestos a muchos peligros e incluso arriesgando su vida para llevar el sustento a sus hogares, las personas que les brindan un trabajo a estos niños y niñas se aprovechan de la inocencia e ignorancia de estos pagándoles muy poco y explotándolos ya que estos niños desconocen de sus derechos, en algunos casos llegan a abusar de ellos y a veces por no perder lo poco que ganan se quedan callados y no los denuncian por miedo. Estos niños están sometidos a ingresar en pandillas, las drogas e incluso a ser los futuros extorsionistas del país y de tanto sufrir maltratos ellos se mentalizan que el dinero es lo único que les importa y lo consiguen a toda costa sin importarles nada ello ocurre en todas partes del Perú, mi investigación se centra en la Comunidad Autogestionaria de Huaycan lugar cercano a domicilio donde he venido advirtiendo mucha mendicidad en niños y adolescentes. Esta situación debería ser tomada con más importancia y no como un problema más de la sociedad, buscarle una posible solución y sobre
todo el gobierno debería tomar conciencia de lo que cada día sufre la niñez.
Con fecha 18 de Marzo del 2004 se promulgó la Ley N° 28190 Ley que protege a los menores de edad de la mendicidad a efecto de otorgar directrices
y Órganos Rectores a fin de proteger a los menores que mendigan en las calles sin ninguna protección e incluso han sido víctimas de trata de personas, ya que hay estudios sobre niños(as) que son alquilados y son dopados con tóxicos para que todo el día duerman y expuestos en las calles para que supuestas madres pidan limosnas o vendan caramelos en las esquinas, ello constituye maltrato infantil penado por el Código Civil cuando establece sanciones a los padres denominado suspensión de la patria potestad y si reinciden puede perder la patria potestad de sus hijos; así como dichos niños(as) y /o adolescentes pueden ser dados en adopción si se determina judicialmente su situación de maltrato y/o abandono.
Habiendo transcurrido más de 16 años de la promulgación de la Ley 28190 Ley que protege a los menores de edad de la mendicidad seguimos apreciando en la calle hasta altas horas de la noche, niños dedicados a la mendicidad haciendo piruetas en las esquinas a cambio de que se les pueda dar unas monedas; pero siempre bajo el ojo vigilante de una persona adulta; por lo que mi investigación será un estudio de la ineficacia de dicha norma y acerca de lo que las instituciones involucradas han realizado para evitar que los niños(as) y adolescentes sigan mendigando.
