ANÁLISIS DE AUTORIZACIÓN DE VIAJE DE MENOR EN EL EXPEDIENTE 20080-2018 2º JUZGADO DE FAMILIA DE LIMA NORTE SEDE MBJ CONDEVILLA”

Abstract

El cometido de investigación presenta un argumento de gran importancia dentro de la presencia jurídica y social acerca de la autorización de viaje de menor solicitada por la madre sin reconocimiento del padre en el Perú en el expediente 20080-2018. Dentro del primer capítulo se ha planificado la obtención del expediente completo del cual en el cual se baso nuestro trabajo, búsqueda de 03 trabajos que guardan relación, sentencias sobre la materia, revistas científicas que tengan relación con lo analizado. En el capítulo segundo, se desarrolla todo lo concerniente a la autorización de viaje de menor dentro del país y fuera del país, partiendo desde un concepto de autorización de viaje de menor y sus clases estipulado en la normativa del Perú como en la de otros países. La doctrina no define lo que es la autorización de viaje de menor, sí lo hacen respecto a la sustracción del menor. Se ha realizado fuerza sobre los fundamentos, caracteres, órganos que intervienen en la solicitud de autorización de viaje de menor dentro de nuestro país y fuera de él de los niños, niñas y adolescentes, todo con el propósito de cubrir una mejor comprensión al momento de estar frente a un caso de solicitar la autorización de viaje de un menor.

The investigative role presents an argument of great importance within the legal and social presence regarding the minor's travel authorization requested by the mother without father's recognition in Peru in file 20080-2018. Within the first chapter it has been planned to obtain the complete file from which our work was based, search for 03 related jobs, judgments on the subject, scientific journals that are related to what was analyzed. In the second chapter, everything concerning the authorization of minor travel within the country and outside the country, starting from a concept of travel authorization for minors and their classes stipulated in the regulations of Peru as in the from other countries. The doctrine does not define what a minor's travel authorization is, it does they do with respect to the abduction of the minor. Strength has been made on the foundations, characters, bodies involved in the minor's travel authorization request within our country and outside it of children and adolescents, all with the purpose of covering a better understanding when facing a case of request the travel authorization of a minor.
