Resumen
El propósito de la presente tesis fue determinar la relación existente entre el proceso penal y el sistema de garantías constitucionales establecidas por la Constitución peruana de 1993; para lo cual se llevó a cabo un trabajo de carácter dogmático, no experimental, transversal, descriptiva, donde la unidad de análisis estuvo constituida por las fuentes formales del derecho: doctrina, jurisprudencia y normatividad; empleándose la técnica del fichaje y el análisis de contenido, y como instrumentos de recolección datos las fichas y ficha de análisis documental respectivamente. Se obtuvo como resultado que con todo, las bases garantistas del proceso penal son los que expresan la vinculación de la legislación y la práctica procesal a la Constitución y a los diversos instrumentos de derechos humanos que vinculan al Estado; esta necesidad de que el Estado vele por el respeto y la protección de los derechos fundamentales del imputado obliga a que se definan en la Constitución los límites del ejercicio del poder estatal, estableciendo las reglas mínimas de un debido proceso penal, configurándose “un diseño constitucional del proceso penal”. Concluyendo que el fundamento de la relación entre el sistema de garantías constitucionales y el proceso penal peruano se funda en el principio de dignidad de la persona; donde el imputado o acusado pueda obtener la tutela judicial efectiva de los derechos con miras a evitar situaciones de indefensión y de contravención a las garantías constitucionales
