Valoración de prueba ilícita en casos de delitos de corrupción de funcionarios en el proceso penal Peruano

Resumen
El objetivo de la investigación fue realizar un análisis jurídico sobre los fundamentos jurídicos para valorar la prueba ilícita en casos de delitos de corrupción de funcionarios en el proceso penal peruano.; para lo cual se realizó una investigación dogmática, transversal, descriptiva, no experimental, careciendo de delimitación temporal y espacial el problema por el tipo de investigación realizada. La unidad de análisis estuvo constituida por la doctrina, jurisprudencia y normatividad. Se utilizaron como técnicas el fichaje y el análisis de contenido, utilizando como instrumentos de recolección datos las fichas y ficha de análisis de contenido respectivamente. Entre los métodos empleados tenemos al exegético, hermenéutico, argumentación jurídica. La investigación ha demostrado que existen argumentos jurídicos que justifican que la doctrina o teoría de la ponderación de intereses, admite la valoración de la prueba ilícita, a efectos de proteger otros valores constitucionales de mayor relevancia que los vulnerados. Por lo que la prueba ilícita es válida cuando el interés en descubrir y perseguir el delito es claramente superior al derecho individual afectado, excepción que podría aplicarse precisamente en casos de delitos de corrupción de funcionarios, donde el derecho individual del imputado puede ceder frente al interés de descubrir y perseguir dichos delitos
