Eficacia del Ius Puniendi del estado frente a las garantías y derechos fundamentales del imputado en el marco de las nuevas formas de criminalidad en el Perú

Resumen
El objetivo de la investigación fue determinar y analizar el tipo de relación que existe entre la eficacia del ius puniendi del Estado frente a las garantías y derechos fundamentales del imputado en el en el marco de las nuevas formas de criminalidad en el Perú; para lo cual se realizó una investigación dogmática, transversal, explicativo, no experimental, careciendo de delimitación temporal y espacial el problema por el tipo de investigación realizada. La unidad de análisis estuvo constituida por el análisis de la doctrina, jurisprudencia y normatividad. Se utilizaron como técnicas el fichaje y el análisis de contenido, utilizando como instrumentos de recolección datos las fichas y ficha de análisis de contenido respectivamente. Entre los método empleados tenemos al exegético, hermenéutico, argumentación jurídica. La investigación ha demostrado que en la lucha contra las nuevas formas de criminalidad exige que el Estado emplee su ius puniendi optando por hacer prevalecer el interés y tranquilidad pública frente a las garantías y derechos de los imputados; debido a que la delincuencia moderna se encuentra explorando nuevas formas de ejecutar conductas ilícitas, por ello ante esta circunstancia, el Derecho Penal debe crear otros mecanismos con el fin de hacer frente a estas formas de criminalidad, los mismos que vulneran y afectan los postulados del Estado Constitucional y del garantismo penal, priorizando la seguridad pública, tranquilidad pública frente a la garantía de la libertad y de los derechos constitucionales constituyen las manifestaciones de la tensión entre eficacia y garantía en el marco de las nuevas formas de criminalidad.
