Resumen
La presente investigación cualitativa, busca brindar una solución al problema de la declaración innecesaria de la nulidad de sentencias de primera instancia por parte de las Salas Civiles Superiores peruanas. Para ello, se recurre a un análisis documental de sentencias, así como al uso de estadísticas y entrevistas a los principales operadores de justicia. La información recolectada muestra que, a pesar de las medidas administrativas adoptadas por el órgano jurisdiccional, la problemática descrita se mantiene y produce la vulneración de los principios de economía y celeridad procesal. En vista de ello, se recomienda la modificación del artículo 382 del Código Procesal Civil Peruano, a fin de establecer lineamientos que regulen detalladamente la declaración de nulidad de sentencias por parte de los jueces de segunda instancia en los procesos civiles que son elevados con recurso de apelación. De esta manera, se pretende promover el cumplimiento de los principios de integración y convalidación procesales por parte de los jueces de segunda instancia.
