Resumen
Este trabajo de investigación que se está presentado se denomina “La inaplicación de la
fiscalización posterior en el proceso de contrataciones del estado”, que en el
desenvolvimiento de mi trabajo. he observado, sobre algunas deficiencias o inaplicación
en el proceso de fiscalización posterior, de parte del postor ganador después de conseguir
un buen pro, de parte de la entidad, específicamente por el “Encargado de la
Contrataciones en su caso el Área de Logística”.
Como consecuencia del “principio de presunción de veracidad del Texto Único Ordenado
de la Ley N° 27444 de Procedimiento Administrativo”, establece que el “Principio de
privilegio de controles posteriores”. En el cual, se procederá a aplicar en los procesos
de Contratación del Estado regulado de acuerdo el “artículo 23 del Reglamento de la Ley
de Contrataciones”, así se define la fiscalización posterior como el procedimiento en el
cual cada entidad deberá ejecutar la debida verificar la oferta enviada por el postor
ganador de la buena pro sean en las contrataciones públicas, en el cual tiene el fin de
corroborar sobre la exactitud y/o veracidad de las informaciones, declaraciones o
documentaciones presentadas. Toda esta información presentada por el postor
adjudicatario en la cual formará parte del expediente único de la contratación, el cual se
encuentra en poder del área correspondiente que se encargada de las Contrataciones y/o
área de Logística la cual corresponda, hasta la culminación de la ejecución o para el
archivo documentario.
El presente trabajo también plantea alternativas para que la entidad actúe dentro del marco
legal y sea el caso se declare la nulidad del procedimiento de contratación (fase de
selección y/o fase de ejecución contractual), al detectar documentación, declaración o
información falsa y/o inexacta,
