El presente trabajo se titula “LA VULNERACIÓN DEL PRINCIPIO DE
PRESUNCIÓN DE INOCENCIA POR LOS MEDIOS DE COMUNICACIÓN” y
pretende realizar un estudio sobre la Presunción de Inocencia desde el momento de
la denuncia contra una persona, la captura del imputado y la presentación de esté
por los medios de comunicación; proponiendo fundamentos cognoscitivos y
actividades sobre los diversos factores que abarca la Presunción de Inocencia y la
incidencia de trascendencia que tienen los Medios de información sobre la condena
o absolución de una persona.
Esta influencia permite que un caso investigado en sede fiscal y tramitado en
sede judicial, no tenga la objetividad necesaria para el juzgamiento, porque la
información proporcionada por los medios de comunicación crea criterio adelantado
que inicia en especulaciones que llegan a condenar al imputado, porque se le trato
como culpable; por eso, al respecto analizaremos esta trascendencia de los medios
de información en los órganos jurisdiccionales del Departamento de Tumbes, y si
dicha influencia vulnera el principio de presunción de inocencia.
Teniendo como una de sus conclusiones: que el principio de Presunción de
Inocencia es un derecho fundamental para la adecuada práctica del derecho penal
y su ejecución y está profundamente vinculado y desarrollado en otras garantías
individuales, como el derecho a la libertad, la libertad ambulatoria, el debido
proceso, principio “Indubio Pro reo” y derecho de defensa.
