Resumen
El presente trabajo trata sobre la falta de aplicación del principio de
oportunidad y el proceso de omisión de la asistencia familiar en la 4ta fiscalía
penal corporativo de Huánuco, Como es sabido por la abogacía, el uso del
principio de oportunidad como medida facultativa es obligatoria según
expresa el art. 2 del nuevo Código Procesal Penal; es utilizado por el fiscal
de oficio la petición de las partes. Por mi parte, este estudio se centra en el
impacto sobre dos sub principio del debido proceso en la fase preliminar
dentro del proceso inmediato; en los delitos de exclusión de la ayuda familiar.
La metodología utilizada fue de tipo aplicada, con un enfoque cuantitativo,
tuvo un alcance descriptivo explicativo, y el diseño fue de tipo no
experimental transversal. La población estuvo conformada por todos los
letrados litigantes habilitados de nuestra ciudad; este estudio se tuvo como
muestra un total de 50 letrados que cumplieron con los criterios de inclusión.
y exclusión. La técnica utilizada fue la encuesta y el instrumento utilizado
una cédula de cuestionario sobre la aplicación del principio de oportunidad
y el derecho al plazo razonable. Los resultados arrojaron que no se estaba
registrando los acuerdos; además, el 82% de los letrados mencionaron las
implicaciones de seguridad de no registrar el Acuerdo, las víctimas también
mencionaron que el acuerdo de compensación no fue registrado. Todo ello
nos permitió comprobar que la falta de aplicación del principio. de
oportunidad Sí afecta de manera significativa al debido proceso.
