¿Existe una obligación internacional del estado peruano para la “protección complementaria” de migrantes irregulares de nacionalidad venezolana?

Resumen
Esta tesis es un estudio respecto de la obligación que tiene el Estado peruanos con los
migrantes irregulares venezolanos que se encuentran en su territorio, lo cuales han
migrado a nuestro país debido a la profunda crisis económica, social y política que
atraviesa el vecino país de Venezuela. Si bien el marco del Derecho Internacional de los
Derechos humanos reconoce derechos para estas personas, los países dificultan el
ejercicio de los mismos exigiendo como requisito la condición migratoria regular. Esta
situación se agrava cuando los países, Perú entre ellos, exigen requisitos para el ingreso
de migrantes y regularización de su situación migratoria que son imposibles o muy
difíciles de conseguir para estas personas. Al respecto defendemos la hipótesis de que
el Estado peruano tiene una obligación con los migrantes irregulares, sobre todo si
consideramos que sus políticas han ocasionado que se encuentren en esta situación. Así,
negamos que los Estados puedan exigir cualquier tipo de requisitos de ingreso o
regularización sin considerar la situación de los migrantes, en especial de los migrantes
venezolanos, por lo cual el Estado Peruano tiene una obligación con ellos, la de
promover la regularización migratoria y evitar tener políticas migratorias que fomenten
la vulnerabilidad y marginación de la población migrante venezolana.
