Labor harassment has been implemented in our legal system through the "Ley Orgánica
Reformatoria a la Ley Orgánica del Servicio Público y al Código del Trabajo para prevenir el
Acoso Laboral" in 2017, as a figure that responds to the need to have an specific, detailed and
precautionary regulation to assist workers who are victims of it, however there are several
deficiencies that do not allow a comprehensive treatment of it. So, based on interviews and
doctrinal and jurisprudential instruments, an analysis has been made on the possible reforms of
which this legal institution can be the object with the purpose of outlining a preventive scope and
a comprehensive regulation that can fight with the complexity that entails the denunciation of
these cases, in order to obtain according to the analyzed, a legal criterion that allows to
encompass all the deficiencies in the regulation of labor harassment in order to be able to raise
the necessary reforms.
