Delito de Violación: Práctica de Pericia Medico Legal a la Persona Acusada

Abstract

En el presente trabajo investigativo vamos a manifestar que tan importante es realizar una pericia médico legal dentro de un proceso penal a un presunto sospechoso de violación sexual. Vamos a desarrollar en este tema cuatro capítulos adecuadamente analizados y justificados. Dentro de los respectivos métodos de investigación se logrará llegar a una propuesta en donde se demostrará que es indispensable contar con una tecnología de alta gama, y profesionales capacitados para lograr que se lleve a cabo rutas a seguir en estos casos de violación sexual para que al presunto victimario también se le realice un examen médico legal o peritaje antes de acusarle de dicho delito ya que muchas veces se realizan estas denuncias temerarias maliciosas o por venganza. Este trabajo técnico investigativo y científico está basado en las denuncias efectuadas en la Fiscalía UNIDAD DE ATENCIÓN Y PERITAJE INTEGRAL – Consejo de la judicatura –Policía Judicial JUZGADOS MULTICOMPETENTES, en el período AGOSTO DEL 2020 A FEBRRERO DE 2021, y a la vez entregar pautas jurídicas para su uso, luego del análisis realizado, para todo el personal sanitario y legal que se vea enfrentado a efectuar un peritaje frente a la denuncia de delito sexual. Los informes periciales, son la base del proceso penal, por tal razón, la Fiscalía, ha puesto real énfasis y está trabajando con las instituciones involucradas, a fin de aplicar diligentemente el Sistema Nacional de Medicina Legal, para ello aprobó los protocolos unificados sobre Pericias Médico Legales, relativos a delitos contra la vida, lesiones en general, tránsito y médico psiquiatras, protocolos que deberán ser ejecutados por los organismos e instituciones que forman parte del Sistema: Función Judicial, Fiscalía, Policía Nacional y Servicios Médicos Legales del País. La propuesta de esta investigación es que se realice el examen médico legal al posible victimario y que se tenga un protocolo para este tipo de casos y juzgar de manera correcta este tipo de delito. El propósito del presente anteproyecto es de Ley reformatoria al Código Integral Penal en lo referente al contenido del peritaje médico legal, que garantice su calidad de prueba en el proceso penal.

In the present investigative work we are going to show how important it is to carry out a legal medical expertise within a criminal proceeding to an alleged rape suspect. We are going to develop four adequately analyzed and justified chapters on this topic. Within the respective research methods, it will be possible to arrive at a proposal where it will be shown that it is essential to have high-end technology, and trained professionals to ensure that routes are carried out in these cases of rape so that at presumed perpetrator is also given a forensic medical examination or expert opinion before accusing him of said crime, since many times these reckless, malicious or revenge accusations are made. This investigative and scientific technical work is based on the complaints made in the Prosecutor's Office UNIT OF ATTENTION AND INTEGRAL EXPERTISE - Judicial Council - Judicial Police MULTICOMPETENT COURTS, in the period AUGUST 2020 TO FEBRUARY 2021, and at the same time deliver LEGAL guidelines for its use, after the analysis carried out, for all health and legal personnel who are faced with carrying out an expert opinion in the event of a sexual crime complaint. The expert reports are the basis of the criminal process, for this reason, the Prosecutor's Office has placed real emphasis and is working with the institutions involved, in order to diligently apply the National System of Legal Medicine, for which it approved the unified protocols on Expertise Medical Legal, related to crimes against life, injuries in general, traffic and medical psychiatrists, protocols that must be executed by the organizations and institutions that are part of the System: Judicial Function, Prosecutor's Office, National Police and Legal Medical Services of the Country. The proposal of this investigation is that the legal medical examination be carried out on the possible perpetrator and that there be a protocol for this type of case and correctly judge this type of crime. The purpose of this draft is to amend the Comprehensive Criminal Code Law in relation to the content of the legal medical expert opinion, which guarantees its quality as evidence in the criminal process.
