La presente investigación se centra en la vulneración de los derechos del demandado y la inseguridad jurídica en la que está envuelto al no existir la figura de rembolso por pensiones alimenticias, aunque consecutivamente se demuestre mediante prueba científica de ADN “Ácido desoxirribonucleico” que no es el verdadero progenitor, con esta prueba se logra impugnar la paternidad más no la restitución de la pensión alimenticia. Este no es un tema aislado, ya que mediante la investigación de campo que se realizó se conoció y se reafirmó la necesidad de que se reforme el art innumerado 3 del Código Orgánico de Niñez y Adolescencia, en la cual hay un brecha para que se perjudique a los presuntos progenitores ya que no existe la restitución de lo pagado en pensiones alimenticias cuando se haya impugnado la paternidad de forma exitosa y peor aún no existe una sanción contra la progenitora que actúa de mala fe. This research focuses on the violation of the defendant's rights and the legal uncertainty in which he is involved as there is no reimbursement for alimony, although it is consecutively demonstrated by scientific DNA test "Deoxyribonucleic acid" that it is not the true parent, with this test it is possible to challenge paternity but not the restitution of alimony. This is not an isolated issue, since through the field research that was carried out, the need to reform the innumerable art 3 of the Organic Code of Children and Adolescents was known and reaffirmed, in which there is a gap so that it is harmed to the presumed parents since there is no restitution of what was paid in alimony when paternity has been successfully challenged and worse still there is no sanction against the mother who acts badly..
