La presente investigación relativa a La Sana Crítica Frente a la Tutela Judicial Efectiva en el Sistema Penal Acusatorio Previsto en el Código Orgánico Integral Penal tiene por objetivo identificar si las sentencias cumplen con los principios previstos en el COIP y los estándares enunciados en la sentencia No. 1024-14-EP de la corte Constitucional; así como identificar si existen lagunas jurídicas en cuanto al anuncio de prueba por parte de los sujetos procesales y determinar si la prueba no anunciada oportunamente guarda relación con los principios consagrados en el artículo 454 del COIP; de igual manera diferenciar el sistema penal, estructuras, fases o etapas en las cuales se realizan valoraciones a las pruebas anunciadas por las partes procesales en audiencia; y, finalmente, estudiar el Estado constitucional de derecho, la sana critica, la tutela judicial efectiva, y el sistema penal acusatorio para demostrar que esta herramienta valorativa de la prueba aún es usada por los juzgadores al momento de realizar un análisis de las pruebas desarrolladas en audiencia, y la importancia de la prueba nueva, Por último, se propone aumentar un inciso al art. 617 del COIP, de complementariedad a la admisibilidad de la prueba nueva. The objective of the present investigation regarding The Healthy Criticism Against Effective Judicial Protection in the Accusatory Penal System Provided in the Comprehensive Organic Penal Code is to identify whether the sentences comply with the principles set forth in the COIP and the standards set forth in sentence No. 1024-14-EP of the Constitutional court; as well as to identify if there are legal gaps regarding the announcement of evidence by the procedural subjects and to determine if the evidence not announced in a timely manner is related to the principles enshrined in article 454 of the COIP; hi the same way, differentiate the criminal system, structures, phases or stages in which evaluations are made of the evidence announced by the procedural parties at the hearing; and, finally, study the constitutional rule of law, sound criticism, effective judicial protection, and the accusatory criminal system to demonstrate that this evaluative tool of the evidence is still used by the judges when conducting an analysis of the evidence developed. in hearing, and the importance of the new e evidence Finally, it is proposed to increase a subsection to art. 617 of the COIP, complementary to the admissibility of the new evidence.
