La paternidad de un hijo no reconocido o nacido fuera del vínculo matrimonial, puede formalizarse mediante el reconocimiento voluntario de su progenitor, ya sea ante un notario, un juzgado o al inscribirse, procede inclusive si se encuentra en el vientre materno. Los procesos de investigación de paternidad o su impugnación, ante la dificultad para probar de manera directa la existencia de las relaciones sexuales en las que el hijo fue concebido, se apoyaban principalmente en presunciones.
Actualmente el examen de ADN es considerado como suficiente y excluye las pruebas contrarias a sus conclusiones. Su eficiencia probatoria, sumada al principio del interés superior del niño consagrado en nuestra legislación, lo hace prevalecer sobre las objeciones por posibles violaciones a la integridad o intimidad de las personas sometidas a su examen. It does not mean that the report of the expert, is constituted in sentence.
