La interrelación conceptual médico - jurídica en la administración de justicia

Abstract

De entre los muchos y acuciantes problemas por los que atraviesa la administración de Justicia Ecuatoriana, sobresale la falta de comprensión e interpretación de los conceptos propios de las Ciencias médicas y más específicamente de una de sus especialidades, la Medicina Legal o Forense, que es la que sirve de puente entre esta Ciencia y el Derecho, y que facilita la comprensión científica de los hechos, propia de la Medicina, por los magistrados, abogados y otros servidores de la Justicia, legos en esta materia; concretamente, la dificultad de interpretar correctamente los informes periciales. Este aprieto se puntualiza en los delitos contra las personas, por lo que es necesaria la adopción de un manual de medicina legal. Los objetivos del Trabajo son; 1. Mejorar el nivel de conocimientos médico legales en los operadores de justicia, 2. Detectar las falencias en el nivel de conocimientos e interpretación, de las expresiones médico legales vertidas por lo peritos en sus informes o dictámenes; 3. Determinar los medios que utilizan los operadores de Justicia para descifrar los dictámenes Médico Legales; 4. Proveer un manual de Medicina Legal y jurídica que sirva de herramienta orientadora y de consulta comprensible sobre esta ciencia. La muestra fue de 70 profesionales de un Universo de 160, entre abogados, administradores de justicia, médicos generales y de diversas especialidades entre ellos, legistas. Se realizó esta investigación, en la Ciudad de Quevedo, provincia de los Ríos. Tipo de investigación: descriptivo longitudinal, diseño, no experimental. Como resultados relevantes, según la encuesta realizada, sin hacer distingo entre los profesionales, se señala que el 50% (35) aceptaron que desconocen la terminología médico legal, el 96% (67) consideran que los médicos legistas deberían saber sobre dichas terminologías, el 69% ( 48) indicaron conocer sobre casos que han quedado en la impunidad por la falta de interpretación real del hecho investigado en el campo médico legal, y el 89% (62) creen que la interrelación conceptual de terminologías médica y jurídica mejorará la administración de justicia

The objectives of the work are; 1: Improving the level of knowledge in the medical-legal operators of justice, 2.To detect the shortcomings in the level of knowledge and interpretation, of the medico-legal expressions discharged by the experts in their reports or opinions; 3.Determine the means they use the operators of Justice to decrypt the medico-legal opinions; 4 Provide A handbook of Legal Medicine and legal that would serve as a tool for guiding and understandable consultation on this science.
