Estudio de la sentencia 09906-2012-015 en el delito contra el medio ambiente, en el sector de Isla de Mondragon, Golfo de Guayaquil

Abstract

El presente trabajo es acerca del “Estudio de la Sentencia 09906-2012-015 en el Delito Contra el Medio Ambiente, en el, Sector de Isla De Mondragón, Golfo de Guayaquil.”. Ante el cometimiento de dicho delito el Estado tiene el compromiso de proteger, garantizar y tutelar el cumplimiento de todos los derechos expresados, incluido el derecho de la naturaleza o Pacha Mama, por ser un bien difuso, funda sus derechos en la primacía de la conservación del ecosistema y su protección; originando por lo tanto otra problemática de indudable trascendencia jurídica en las sociedades industrializadas de nuestro tiempo, la necesidad social ante la necesidad económica y la búsqueda de mecanismos jurídicos eficaces para tutelar el medioambiente, sin que se afecten derechos, para ello presentamos un proyecto de ley de reforma para asegurar indicios de procedibilidad para la ejecución del art 247 de COIP, el cual es el delito que estudiamos.

The present work is about the "Study of Sentence 09906-2012-015 in the Offense Against the Environment, in the Sector of Isla de Mondragón, Gulf of Guayaquil.". Faced with the commission of this crime, the State is committed to protect, guarantee and protect compliance with all rights expressed, including the right of nature or Pacha Mama, because it is a diffuse good, founds its rights in the primacy of conservation of the ecosystem and its protection; thus originating another problematic of doubtless legal transcendence in the industrialized societies of our time, the social necessity before the economic necessity and the search of effective juridical mechanisms to protect the environment, without affecting rights, for this we present a bill of reform to ensure indications of procedure for the execution of art 247 of COIP, which is the crime we are studying.
