Último proceso de reforma de la Comisión Interamericana de Derechos Humanos (2011-2013): reflexiones y perspectivas

El presente documento pretende hacer un primer balance del último proceso de reforma de la Comisión Interamericana de Derechos Humanos, la que se llevara a cabo entre los años 2011 y 2013. En ese lapso se sucedieron diversos informes, posiciones, resoluciones y opiniones de todos los actores del Sistema Interamericano, que alimentaron un intenso debate sobre la necesidad de reformar la Comisión con miras a fortalecerla, pero que en el camino también reveló la intención de algunos Estados miembros no necesariamente dirigida hacia tal fortalecimiento. El balance estará constituido por tres partes: la descripción del proceso de reforma, los temas debatidos en él y algunas reflexiones finales. Como conclusión, se obtiene que las reformas aprobadas constituyen un paso hacia adelante —pero aún insuficiente— en la adecuación del Sistema Interamericano en general, y de la CIDH en particular, a los nuevos retos y necesidades del continente americano y el Caribe en materia de derechos humanos, así como respecto de la legitimidad que el propio sistema ha ganado en las últimas tres décadas.
