dc.descriptionThis paper critically analyzes conscientious objection in the context of the new regulation of pregnancy termination in Chile. It affirms that adequate regulation should not be blind to the hostile context in which abortion rights have been enacted and the difficulties experienced. The bioethical requirements that seek to balance the interests involved must consider the legal regulation of the interests at stake, the context in which they are implemented and, fundamentally, the effectiveness of the solutions adopted. Attention should be paid to the risks involved in the proliferation of objections that are not serious and to the political use of conscientious objection to prevent the implementation of women’s reproductive rights. In describing the process of entrenchment, strengthening and expansion of the conscientious objection in Chile, we show how this process has overprotected consciousness and the risks of undermining the effectiveness of the new abortion law, hindering and dilating the enjoyment of rights entrenched by the law. In response, regulatory measures are proposed to reverse this situation, which are obtained mainly from the bioethical literature on the subject and that look at the adverse context of the guarantee of women’s sexual and reproductive rights.en-US
dc.descriptionEste trabajo analiza críticamente el estado de la objeción de conciencia en el contexto de la nueva regulación de la interrupción delembarazo en Chile. Plantea que una adecuada regulación no debe ser ciega al contexto hostil en que dichas prestaciones han sido establecidas y las dificultades que el proceso para su establecimiento ha experimentado.Las exigencias bioéticas que buscan equilibrar los intereses involucrados de manera abstracta deben ser puestas en relación tanto con la regulación jurídica de los intereses en juego como con el contexto donde estos se insertan y, fundamentalmente, orientarse a garantizar la efectividad de las soluciones adoptadas. En particular, debe ponerse atención a los riesgos que conlleva la proliferación de objeciones que no revisten seriedad y a la utilización política de la objeción de conciencia con miras a impedir la implementación de los derechos reproductivos de las pacientes. Al describir el proceso de instalación, fortalecimiento y expansión de la objeción de conciencia en Chile, mostramos cómo esta ha implicado una sobreprotección a la conciencia y los riesgos de minar la efectividad de la nueva ley de interrupción del embarazo, entorpeciendo, dilatando y dificultando el disfrute de las prestaciones contempladas por la legislación. En respuesta, se proponen medidas regulatorias para revertir esta situación, que son obtenidas principalmente de la literatura bioética sobre la materia y que miran el contexto adverso a la garantía de los derechos sexuales y reproductivos de las mujeres.es-ES
