The article criticizes Decree Law No. 17437, enacted on February 18, 1969, which sought to reorganize the Peruvian university system; or rather, the transformation of those essential functions of the university in Peruvian society. The enactment of this law is criticized by the author due to the problems and contradictions it presents, which prevent its effective application in the educational system it intends to affect. Thus, the new law not only reduced the autonomy of the universities, but also minimized student intervention, repressed political activity, limited the academic participation of teachers and, even more seriously, did not take into account the social reality of the country's private and public universities. This is why the author points out that the law under commentary prevents the country's universities from fulfilling their mission of social commitment and criticism with the country's development. In view of this, he proposes that the government reevaluate the law and reformulate it, orienting it towards a dialogue with the university community.El artículo realiza una crítica al Decreto Ley N.º 17437, promulgado el 18 de febrero de 1969, que pretendía reorganizar el sistema universitario peruano; o, mejor dicho, la transformación de aquellas funciones esenciales de la universidad en la sociedad peruana. La dación de dicha norma es reprochada por el autor debido a los problemas y contradicciones que presenta y que impiden su efectiva aplicación en el sistema educativo que pretende afectar. Así, la nueva norma no solo restaba autonomía a las universidades; sino que minimizaba la intervención estudiantil, reprimía la actividad política, limitaba la participación académica de las y los docentes; y, más grave aún, no tenía en cuenta la realidad social de las universidades privadas y públicas del país. Es por ello que el autor señala que la ley bajo comentario impide que las universidades del país cumplan con la misión de compromiso y crítica social con el desarrollo del país. En vista de ello, propone que el Gobierno reevalúe la ley y pueda reformularla orientándola a un diálogo con la comunidad universitaria.
