El presente trabajo desarrolla un esforzado análisis de tres problemas jurídicos inmersos
en una controversia que tomó lugar entre los años 2007 y 2010 en nuestra nación, en
relación a la alegación de afectación de derechos fundamentales de los Waorani
(Tagaeri- Taromenane), Pananujuri (Arablea) y Aushiri -pueblos indígenas- como
consecuencia de la operación de determinadas empresas del rubro petrolero en los
Lotes No. 67 y 39. El caso gira en torno a una Acción de Amparo presentada por la
Asociación Interétnica de Desarrollo de la Selva Peruana – AIDESEP ante el juez
especializado en lo civil de la provincia de Maynas de la Corte Superior de Justicia de
Loreto. Posteriormente, el caso es sometido -como consecuencia de la apelación del
demandante- al juez superior. Finalmente, el Tribunal Constitucional se pronunciará
respecto de la procedencia del recurso de agravio constitucional postulado por
AIDESEP.
