dc.descriptionThe traditional form (i.e. benthamian) of understanding the free proof has involved separating the notion of probability of evidentiary weight idea. This article states that the determination of the weight of evidence cannot be delivered to the preferences of the judge, but that the legal system must provide normative criteria that lead the judicial inferences. Evidence law should regulate de strategies of exclusion, preference and corroboration that guide the evidentiary inferences of the judges when uncertainty in order to minimize the risks of error and to distribute them among the litigants when they are unavoidable. To illustrate this argument, this article offers some examples of the criminal litigation.en-US
dc.descriptionLa forma tradicional (i.e. benthamiana) de comprender la libertad de prueba, ha implicado separar la noción de probabilidad de la idea de peso probatorio. En este artículo se afirma que la determinación del peso de una prueba no puede quedar entregada a las preferencias del juez, sino que el sistema jurídico debe proveer de criterios normativos que guíen las inferencias judiciales. El derecho de prueba debe regular las estrategias de exclusión, preferencia y corroboración, que guían las inferencias probatorias de los jueces en contextos de incertidumbre, con el fin de minimizar los riesgos de error, y de repartirlos entre los litigantes cuando ellos sean inevitables. Para graficar este argumento, el artículo ofrece algunos ejemplos de la litigación penal.es-ES
