The paper denies that art. 15 of the chilean Constitution establishes a right not to vote. What is instead protectected by this article is the citizen's electoral decision-making process. Under this perspective are considered several statements from chilean electoral system. Since a constitutional right not to vote is not included in it, any new legal statement that establishes compulsory voting would involve no transgression to art. 15 of the Constitution.El artículo niega que el artículo 15 de la Constitución Política de Chile consagre el derecho a no asistir a sufragar. Lo que protege en cambio es la formación de la voluntad electoral del ciudadano. Bajo esta perspectiva se consideran varias disposiciones del sistema electoral chileno. Al no incluir este un derecho constitucional a la abstención electoral, cualquier restablecimiento legal de la obligación de sufragar no significaría afectación alguna del artículo 15 de la Constitución.
