The academic article intends to put into discussion the situation of the prison emergency as well as the health and the invisible violence of the state towards the population deprived of liberty, which is in situations of violation of their rights, for this a bibliographic review was carried out around the national and regional situation of populations deprived of liberty, therefore situations generated in the context of the confinement in a pandemic are pointed out, such as the state's response to the latter. Referring to the fact that the expression of interest by executing officials from various State institutions, in whatever roles they are assigned to fulfill the rights of citizens, is not enough, and that there is structural violence in contexts of confinement that must be investigated, for its subsequent approach and intervention, recognizing that academic development may be transitory without a true assumption of responsibilities by state institutions towards the fulfillment of the rights of persons deprived of liberty.El artículo académico pretende poner en discusión la situación de la emergencia penitenciaria como sanitaria y la invisible violencia del Estado hacia la población privada de libertad, que se encuentra en situaciones de vulneración de sus derechos. Para esto, se realizó una revisión bibliográfica en torno a la situación nacional como regional de poblaciones privadas de libertad. Por lo tanto, se señalan situaciones generadas en el contexto del encierro en pandemia, como la respuesta del Estado ante esta última. No basta la manifestación de interés por parte de oficiales ejecutores de las diversas instituciones del Estado, en cualesquiera sean los roles en los que se encuentren asignados para cumplimiento de derechos de los ciudadanos/as.Existe una violencia estructural en contextos de encierro que deben ser investigada para su posterior abordaje e intervención. Reconociendo que la elaboración académica puede resultar transitoria e insuficiente, sin una verdadera asunción de responsabilidades de parte de las instituciones del Estado.
