Vantagens e desvantagens do pregão

Abstract

The present work has the goal to analyze the advantages and disadvantages of face trading compared to another bidding types. To develop this work we defines bidding, Public Administration, presents the bidding applicable principles, describes each bidding types, followed by the description of face trading and its characteristics, and also mention the new directions of public contracting. The descriptive research method was used to achieve the research goals. It was done a qualitative, exploratory, field and bibliographic research. A theoretical-empirical work was developed that was divided into five chapters. The research was developed to analyze the advantages and disadvantages of face trading. To perform the analysis, data were collected using questionnaires answered by the criers of the city hall of Jumirim/SP and the town halls of Tietê/SP and Laranjal Paulista/SP. The study results bring a perspective of advantages and disadvantages of face trading. One of the advantages is that to use this modality there are no value limits. Another one is the process celerity, that is shown by this study that they occur because of some prerogatives inherent in the process. Among them we can name that the deadline for the publication of the acts is smaller than the others, beyond that, all procedure occurs in a single act. In this act, there is a sequence of steps that must be followed. First of all, there are the price bids, after that there must be a negotiation between the interested company and the crier to reduce the offer value. At this time there is a phase inversion followed by the adjudication made by the price bids and finally, the manifestation of the appeal may occur only in the act of the session. As a disadvantage, we can highlight that is only possible to use the criterion of the better price, also there are a forbidden to use in the construction. Yet, can occur that the fair participating companies to reduce its prices to a high low due to the high level of the competitiveness, which increases the number of non-performance of the contract. Based on the surveys it is possible to note the importance of the trading for public contracting.
