O Termo de Referência e o Projeto Básico como ferramentas de eficiência no processo licitatório

Abstract

It is essential the need for dissemination of knowledge related to the bidding process to the public officials responsible for accomplishing them, as well as suppliers of goods and services to the Administration. For this reason, this paper analyzed the importance of the basic design and the benchmark for the effectiveness of the bidding process of the Brazilian Public Administration. First, explained the structure of the Brazilian bidding process, rules, principles, modalities and types; then detailed it is the object of study, the basic design and the terms of reference; and were also identified by means of the judgments issued by the Court of Audit, the months of April, May and June 2011, 2012 and 2013, the main "vices" practiced under reference and basic designs that compromise the effectiveness of bidding process of public administration. It was concluded that the basic design tools and terms of reference are of great importance for the success of the bidding process, thus suggesting that managers of public agencies to strengthen investments in training and capacity building of those responsible in the preparation of basic projects and term of references.
