| dc.description | La protección integral de la niñez y la adolescencia se sustenta en el principio del interés superior de los niños y adolescentes, principio garantista que impone su consideración obligatoria en la interpretación y aplicación de la Ley. El interés Superior es un concepto dinámico e indeterminado, que recogido en la Ley Orgánica para la Protección de Niños, Niñas y Adolescentes, establece pautas para su determinación, en cada caso concreto. Una de esas pautas se refi ere, al necesario equilibrio entre derechos y deberes de los niños y adolescentes. El presente artículo analiza la naturaleza de los derechos y deberes de los niños y adolescentes y el sentido que debe atribuirse al término necesario equilibrio entre ellos, con la intensión de plantear un tratamiento hermenéutico adecuado para este postulado del interés superior. | |

Guarantor principle that imposes its mandatory consideration in the interpretation and application of the Law. Superior interest is a dynamic and indeterminate concept, which contained in the Organic Law for the Protection of Children and Adolescents, establishes guidelines for its determination, in each specifi c case. One of these guidelines refers to the necessary balance between rights and duties of children and adolescents. This article analyzes the nature of the rights and duties of children and adolescents and the meaning that must be attributed to the necessary balance between them, with the intention of proposing a suitable hermeneutic treatment for this postulate of superior interest. | |
