Abstract:The article contains an analysis of the main aspects of the jurisprudence of the Inter-American Court of Human Rights that gave content to the right to health, mainly, with an indirect treatment, through the references to other rights, but with implications in this area. The study focuses on how this Court has decided –and if could do so about the right to health, taking as the aim, then, find the applicable standards of this right, which are important for States, as these suppose positive obligations for them.Finally, the conjunction and reception that of such treatment should be performed in domestic law is examined, considering the interpretative guidelines that emerge from the American Convention of Human Rights. The article reflects, in sum, the treatment thatthe Inter American Court of Human Rights has given to the right to health, considering some jurisdictional issues, as well as establishing some perspectives with reference to its future prospects.Resumen: Se realiza un análisis de las principales líneas jurisprudenciales emanadas de la Corte Interamericana de Derechos Humanos que otorgaron contenido al derecho a la salud, principalmente, en forma indirecta, a través de fallos que se remiten a otros derechos, pero con implicancias en esta materia. El estudio se enmarca en cómo este Tribunal se ha expedido —y podría hacerlo— sobre el derecho a la salud, teniendo por objetivo, entonces, encontrar los estándares aplicables a este derecho, los que serán detrascendencia para los estados, pues suponen obligaciones prestacionales y positivas para los mismos. Por último, se realiza una aproximación a la conjunción y recepción que debiera realizarse de dicho tratamiento en el derecho interno, tomando en consideraciónpautas interpretativas que surgen del propio texto de la Convención Americana sobre Derechos Humanos. El artículo reflexiona, en suma, respecto del tratamiento que la Corte Interamericana de Derechos Humanos le ha dado al derecho a la salud, considerando algunos aspectos competenciales, así como estableciendo algunas pautas enatención a su futura perspectiva.
