LA REFORMA DE LA LEY ORGÁNICA DEL TRABAJO: ¿UN ASUNTO DE MORA LEGISLATIVA O UNA OPORTUNIDAD PARA LEGALIZAR LA TRANSICIÓN DEL CAPITALISMO AL SOCIALISMO?

Resumen
The Constitution of the Bolivarian Republic of Venezuela in its Transitory Provisions established that within the first year, starting from its installation, the National Assembly should approve the reform of the LOT. The arrears of Parliament to comply with the constitutional mandate has been extended in time, initiating the debate on this subject in 2002 with the introduction of a reform project, approved in first reading in June 2003, whose passage to the second discussion not successfully completed. In late 2009, amid deep conflicts of interests of the sectors involved and the adoption of legislative reforms to strengthen the national significance of the model XXI Century Socialism promoted by President Chávez, the deputies representing the Standing Committee on Developing. Comprehensive Social fidel, known unofficially, a working paper that exceeds the constitutional guidelines for tuning the native labor law framework to the new socioproductive scheme which currently governs the country. We developed a descriptive documentary research, which aims to systematically noted the partnership between the variables under study, analysis and interpretation of the current nature and composition of both the processes and internal and external relations of the phenomena associated with it. The tendency to impose the Reformation of the LOT strengthens the active participation of workers in the management of the processes carried into the workplace, stresses the protectionist nature of Venezuelan labor law and deviates from the trend flexibilization hosted by the native legal framework adopted in 1997, in order to adjust the text to the new figures, demands and requirements demanded by the Bolivarian Revolution, which undoubtedly has penetrated all Venezuelan institutions.
La Constitución de la República Bolivariana de Venezuela, en sus Disposiciones Transitorias, estableció que dentro del primer año, contado a partir de su instalación, la Asamblea Nacional debía aprobar la reforma de la LOT. La mora del Parlamento en cumplir con el mandato constitucional se ha extendido en el tiempo, iniciándose el debate sobre este tema en el año 2002, con la presentación de un Proyecto de Reforma, aprobado en primera discusión en junio de 2003, cuyo paso a segunda discusión no culminó con éxito. A finales de 2009, en medio de profundos conflictos de intereses de los sectores involucrados, y de la aprobación de reformas legislativas con trascendencia nacional para consolidar el modelo del Socialismo del Siglo XXI promovido por el Presidente Chávez, los diputados representantes de la Comisión Permanente de Desarrollo Social Integral presentaron, conocido extraoficialmente, un papel de trabajo que supera los lineamientos constitucionales, buscando sintonizar el marco jurídico laboral patrio al nuevo esquema socioproductivo que actualmente rige en el país. Se desarrolló una investigación de tipo documental descriptiva, cuyo objetivo fue señalar en forma sistemática las relaciones de asociación entre las variables objeto de estudio; el análisis e interpretación de la naturaleza actual y composición, tanto de los procesos como de las relaciones internas y externas de los fenómenos vinculados a ella. La tendencia a imponerse con la Reforma de la LOT afianza la participación protagónica de los trabajadores en la gestión de los procesos llevados dentro de los centros de trabajo, recalca el carácter proteccionista de la legislación laboral venezolana y se aparta de la tendencia flexibilizadora acogida por el marco jurídico patrio aprobado en 1997, a fin de adecuar el texto a las nuevas figuras, demandas, y requerimientos exigidos por la Revolución Bolivariana, que sin duda alguna ha ido penetrando toda la institucionalidad venezolana.
