This article shows a critical incident as descriptive analysis of the competition as a meansof income to government on labor rights of contract workers. Whereas under theprovisions of the Statute Law (2002), the scheme is applicable to staff labor law and therelevant contract. A content analysis of the collected documents was conducted; the legalinterpretation was used, for the purpose of interpreting legal instruments analyzed. It wasconcluded that all citizens have the right to participate freely in public administrationwithout other limitations than those established in the Constitution and the Law on theStatute of the Civil Service (2002).El presente artículo tiene como finalidad mostrar un análisis crítico descriptivo de cómoincide el concurso como vía de ingreso a la administración pública sobre los derechoslaborales de los trabajadores tercerizados, considerando que por disposición de la LeyEstatutaria (2002), el régimen aplicable al personal contratado es la legislación laboral y elrespectivo contrato. Se realizó un análisis de contenido de los documentos recopilados, seempleó la hermenéutica jurídica, a los fines de interpretar los instrumentos legalesanalizados. Se concluyó que todos los ciudadanos tienen derecho de participar librementeen la administración pública sin más limitaciones que las establecidas constitucionalmentey en la Ley del Estatuto de la Función Pública (2002).
