LA FRANQUICIA EN LAS EMPRESAS CERVECERAS Y RELACIÓN LABORAL ENCUBIERTA

Resumen
In Venezuela the world of franchising appears to rise. Under this business strategybrewers modified the distribution of its products, from an independent distributor to afranchised dealer, which is awarded the false role of entrepreneur. From this perspective,the paper analyzes the franchise and disguised employment relationship in order toinvestigate contracts to franchising, commercial contract and covert relationships. To thisend, a theoretical investigation was conducted; the methodology consisted of a review ofsecondary sources. The results show that the franchise in the brewing industry defines asystem of marketing products and services. Therefore, aims to improve the functioning ofthe sale, distribution and marketing within a market to develop supply chains. Theconclusion is that the franchise is presented as an alternative flexible and adaptable tochanging Market Company. The contract is part of a franchise business vision, which leads to conceal labor relations eradicating their labor law regulations as north to the hiringof labor force or negotiation. En Venezuela el mundo de la franquicia se presenta en ascenso. Bajo esta estrategiaempresarial las empresas cerveceras han modificado la distribución de sus productos,pasando de un distribuidor independiente a un distribuidor bajo franquicia, al cual se leadjudica el falso rol de empresario. Desde esta perspectiva, el trabajo pretende analizar lafranquicia y relación laboral encubierta, a fin de indagar los contratos con las franquicias,el contrato mercantil y las relaciones encubiertas. Para tal fin, se realizó una investigaciónteórica, la metodología consistió en una revisión de fuentes secundarias. Los resultadosreflejan que la franquicia en el sector cervecero define un sistema de comercialización deproductos y servicios. Por este motivo, se dirige a mejorar el funcionamiento de la venta,distribución y comercialización dentro de un mercado para desarrollar cadenas dedistribución. Se concluye que la franquicia se presenta como una alternativa de empresaflexible y adaptable a los constantes cambios del mercado. El contrato para franquicia seenmarca en una visión comercial, con la cual se conduce a encubrir las relacioneslaborales erradicando de sus normativas el Derecho del Trabajo como norte para lacontratación o negociación de fuerza laboral.
