| dc.description | The objective of this work focuses on identifying the ethical foundations present in the activity of the Venezuelan labor judge. It was based on the principles of Escobar (2004), Velez and Sarmiento (2003), Smith (2010), Guanipa (2013), among others. The type of research is documentary, because they resorted to consultation documents, legal texts and encyclopedias, among others, in order to provide a series of data highly relevant to the investigation, with no design experimental documentary using collection techniques and analysis of bibliographic information and using the techniques of hermeneutics, which is the science of interpreting legal texts. From these perceptions, this procedure supports the description of research steps that are followed in writing and sequential narrative form, clearly explaining what they are, these being framed within the methodology used in this study. As a result of the study, it was evident that the success of the valuation system of sound criticism in the Procedural Labor Law depend on the knowledge, preparation and ongoing training of qualified judges, scholars of law for the correct application of the law and social science in constant evolution society, which is part of the sociological, psychological, physical and technical reasoning under the experience, the judge must make his intellectual operation assessment of the evidence. | en-US |
| dc.description | El objetivo del presente trabajo se enfoca en identificar los fundamentos éticos presentes en la actividad del juez laboral venezolano. Se sustentó en los postulados de Escobar (2004), Vélez y Sarmiento (2003), Suárez (2010), Guanipa (2013), entre otros. El tipo de investigaciones es documental, debido a que se recurrió a la consulta de documentos, textos jurídicos y enciclopedias, entre otros, con el objeto de proporcionar una serie de datos de gran relevancia para la investigación, con un diseño documental no experimental, empleando técnicas de recolección y análisis de la información bibliográfica y el uso de las técnicas de la hermenéutica, que es la ciencia de interpretar los textos legales. A partir de estas percepciones, este procedimiento admite la descripción de los pasos de la investigación que se siguen por escrito, en forma narrativa y secuencial, explicando claramente en qué consisten, enmarcándose estos dentro de la metodología empleada en el presente estudio. Como resultado del estudio se pudo evidenciar que el éxito del sistema de valoración de la sana crítica en la Ley Orgánica Procesal del Trabajo (LOPTRA) dependerá del conocimiento, preparación y capacitación continua de jueces idóneos, estudiosos de la ley para la correcta aplicación del derecho como ciencia social de constante evolución en la sociedad, lo cual forma parte del razonamiento sociológico, psicológico, físico y técnico con arreglo a la experiencia, debiendo efectuar el juzgador en su operación intelectual de valoración de las pruebas. | es-ES |
