Resumen
The objective of this paper was to analyze the General Social Security of Migrant Workers in Venezuela against the floor of social protection of the ILO. Was sustained under different postulates as, Romero (2003), the Constitution of the Bolivarian Republic of Venezuela (National Constituent Assembly, 1999), Labor Law, Men and Women Workers (Presidency of the Republic, 2012), Social Security Act (National Assembly, 2012), and the Immigration and Migration Law (National Assembly, 2004); in addition to a collection of legal international conventions through the International Labor Organization ILO. The type of research is documentary, with a non-experimental design, measurement of cross sectional, with a design of bibliographic. As a result failed to show that all the Venezuelan laws speak of the treatment of migrant workers in a regular situation, for the granting of their protection and security still great similarity between the set of basic guarantees of social security laid down in the floor of protection proposed by the ILO and the benefits established in the Venezuelan legal system to Venezuelans and foreigners in a regular situation within the country; however there are no regulations that establish the possibility of extending social security to migrant workers in an irregular situation within the country, by splitting the fundamental principle of the ILO that is inclusion and non-discrimination of workers by their nationality or legal status. La presente investigación tiene como objetivo general analizar la seguridad social de los trabajadores migrantes en Venezuela frente al piso de protección social de la OIT. Se sustentó bajo distintos postulados como los de Romero (2003), Constitución de la República Bolivariana de Venezuela (Asamblea Nacional Constituyente, 1999), Ley Orgánica del Trabajo, los Trabajadores y las Trabajadoras (Presidencia de la República, 2012), Ley Orgánica del Sistema de Seguridad Social (Asamblea Nacional, 2012) y la Ley de Extranjería y Migración (Asamblea Nacional, 2004); además de una recopilación legal de los convenios internacionales a través de la Organización Internacional del Trabajo (OIT). El tipo de investigación es documental, con un diseño no experimental, de medición transaccional, con un diseño de tipo bibliográfico. Como resultado se pudo evidenciar que todas las leyes venezolanas consagran el tratamiento de los trabajadores migrantes en situación regular, para el otorgamiento de su protección y seguridad existiendo gran similitud entre el conjunto de garantías básicas de seguridad social establecido en el piso de protección propuesto por la OIT y las prestaciones establecidas en el ordenamiento jurídico venezolano para los venezolanos y extranjeros en situación regular dentro del país; sin embargo no se observa ninguna normativa que establezca la posibilidad de extender la seguridad social a los trabajadores migrantes en situación irregular dentro del país, consagrando el principio fundamental de la OIT que es la inclusión y la no discriminación de trabajadores por su nacionalidad o condición legal.
