(Legal consequences of insurance activity made by cooperative insurance associations in Venezuela)

This research aims to examine the legal consequences arising from the insurance business by insurance cooperative associations in Venezuela legally basing on the Constitution of the Bolivarian Republic of Venezuela (National Constituent Assembly, 1999) Special Law of Cooperative Associations (National Assembly, 2001a), Law on Insurance Activity (National Assembly, 2010a), among others, and based on the theories of Estecche (2011), Garcia (2001) and Molina (2006). The study was legal, documentary and descriptive, with a bibliographical design, not experimental, using the documentary observation and signing as techniques for data collection, and the card as a tool to gather information. The technique of analysis and interpretation of the results was the legal interpretation and analysis of content, using the deductive method. The results showed that there are two main legal consequences of the insurance business by insurance cooperative associations in the country, from the lack of guarantees to the insured prior to contract with them, and possible fraud of rights, once agreed the contract with them. The conclusion about the lack of guarantees to the insured, it is checked from the possible violation of the principle of equality, since a different accounting applies to cooperatives with regard to insurance companies, as well as the consent freely agreed certain conditions, and possible fraud of rights resulting from insurance cooperatives acting in fact, and even his appearance at the proceedings against them, based on a possible evasion of the law, given that the regulatory framework places the insured as weak legal relationship.
La presente investigación estuvo dirigida a examinar las consecuencias jurídicas derivadas de la actividad aseguradora realizada por las asociaciones cooperativas de seguros en Venezuela, fundamentándose legalmente en la Constitución de la República Bolivariana de Venezuela (Asamblea Nacional Constituyente, 1999), Ley Especial de Asociaciones Cooperativas (Asamblea Nacional, 2001a), Ley de la Actividad Aseguradora (Asamblea Nacional, 2010a), entre otros, y basándose en las teorías de Estecche (2011), García (2001) y Molina (2006). El estudio fue jurídico, documental, y descriptivo, con un diseño bibliográfico, no experimental, utilizando la observación documental y el fichaje como técnicas de recolección de los datos, y la ficha como instrumento para recopilar la información. La técnica de análisis e interpretación de los resultados fue la hermenéutica jurídica y el análisis de contenido, utilizándose el método deductivo. Los resultados obtenidos evidenciaron que existen dos grandes consecuencias jurídicas de la actividad aseguradora realizada por asociaciones cooperativas de seguros en el país, a partir de la falta de garantías hacia el asegurado, previamente a contratar con éstas, y el posible fraude de derechos, una vez pactado el contrato con ellas. Se concluye sobre la falta de garantías hacia el asegurado, se verifica a partir de la posible violación del principio de igualdad, por cuanto se aplica una contabilidad diferente a las cooperativas con respecto a las empresas de seguros, así como por el consentimiento libremente acordado en unas condiciones determinadas, y el posible fraude de derechos, resultado de cooperativas de seguros actuando de hecho, e inclusive su incomparecencia en los procedimientos contra ellas, con base a un posible fraude de Ley, en vista de que el marco regulatorio sitúa al asegurado como débil jurídico de la relación.
