Desarrollo de la libertad religiosa y de culto en el ordenamiento jurídico colombiano

Abstract

La libertad religiosa y de culto se enmarca dentro del ordenamiento jurídico colombiano, haciéndose así parte del bloque de constitucionalidad, las nuevas dinámicas dentro de los diferentes roles donde el individuo y el Estado bajo el Ius cogens, nos permite ver la primacía de la dignidad humana, fundamento del Estado social de derecho; Con base en lo anterior, nace la pregunta: ¿existe una real y efectiva protección de la libertad religiosa y de culto en el ordenamiento jurídico colombiano dentro del contexto del poder político, social, administrativo y educativo sin menos cabo de los derechos de las demás entidades y organizaciones religiosas y de las personas en lo individual y colectivo? Para el análisis investigativo se aplicó la metodología deductiva del ordenamiento jurídico y el bloque de constitucionalidad colombiana en contraste entre la realidad jurídica y la realidad social religiosa. El estudio demuestra que no existe dicha protección jurídica, sino, mediante la acción de tutela, el motivo de esta aseveración se puede ver cuando cada mes en las escuelas se celebra una misa católica Romana del Vaticano vulnerando un concurso de derechos contrariando la Laicidad del Estado y adentrándose más a los esquemas de adoctrinamiento religioso. Puedo concluir que, con base en lo anterior no existe contraste normativo en el ordenamiento nacional e internacional, pero, sí en su aplicabilidad esto, nos permite afirmar que, no hay verdadera libertad religiosa y de culto en Colombia, lo que implica que el derecho material sin sentencia tutelar de por medio es letra muerta

Religious freedom and freedom of worship were framed within the Colombian legal system, thus becoming part of the block of constitutionality, the new dynamics within the different roles where the individual and the State under the Ius cogens, allows us to see the primacy of human dignity, the foundation of the social state of law; Based on the above, the question arises: Is there a real and effective protection of religious freedom and freedom of worship in the Colombian legal system within the context of political, social, administrative and educational power, without lessening the rights of other religious entities and organizations and of people individually and collectively? For the investigative analysis, the deductive methodology of the Colombian legal system and the block of constitutionality was applied in contrast between the legal reality and the religious social reality. The study showed that there is no such legal protection, but through the tutelage action, the reason for this assertion can be seen when every month in the schools a Roman Catholic mass of the Vatican is celebrated violating a contest of rights contrary to the secularity of the State and going deeper into the schemes of religious indoctrination. I can conclude that, based on the above, there is no normative contrast in the national and international order, but in its applicability, this allows us to affirm that there is no true freedom of religion and worship in Colombia, which implies that the material law without a tutelary sentence is a dead letter
