Resumen
Analyzing the Brazilian legal culture of the nineteenth century there are singular and constant transitions. Jurists play the main role, especially in the second half of this century, in significant moments as the discussions about the Civil Code, positive law, legal education, slavery and the republican movement. Therefore, the jurist, in any of the multiple and simultaneous legal careers that managed to have, can be a guide to comprehend the development of a truly Brazilian legal culture in the nineteenth.In a previous approach, there are three profiles of jurists in the end of the nineteenth century that overlap each other, something like a romantic jurist, an eloquent and a third, positivist or scientific. The objective of this paper is to present evidence of the specificity of discourses circulating in the capital of the empire, aiming to strengthening the hypothesis of a unique profile of the jurists at the capital, not determined by their studies or institutional affinities, but because of legal institutions and the local practices.
Analizando la cultura jurídica brasileña del siglo XIX se puede observar, en largas líneas, un panorama muy heterogéneo y de constantes transiciones. Hay un protagonismo de los juristas, especialmente en la segunda mitad de este siglo, en los momentos significativos como los debates acerca de la codificación, las primeras legislaciones positivas, la enseñanza jurídica, la esclavitud y el movimiento republicano.Por lo tanto el jurista, en cualquier de las múltiples y simultaneas carreras jurídicas que haya adoptado, nos sirve de guía para comprehender la formación de una cultura jurídica esencialmente brasileña en este siglo.Por lo tanto, y a modo de aproximación preliminar, reconocemos tres perfiles de juristas que se superponen al final del siglo XIX: un jurista romántico, uno elocuente y un tercero, positivista o científico. Se pretende presentar indicios de la especificidad de los discursos que circulaban en la capital del imperio con el objetivo de reforzar la hipótesis de un perfil propio de los juristas que allí actuaban, no en función de la formación jurídica o de la pertenencia a escuelas propias sino en razón de las instituciones jurídicas y de la praxis local.
