ResumenEl presente artículo profundiza sobre la pensión de supervivencia en cuanto a su forma de distribución y requisitos de otorgamiento, de la manera en que los Juzgados Laborales del Circuito de Barranquilla-Colombia, aplican el artículo 13 de la Ley 797 de 2003 que contempla los efectos de la convivencia entre un compañero o compañera permanente con sociedad conyugal anterior no disuelta y derecho a percibir la pensión, indicando que la prestación se dividirá entre ellos o ellas en proporción al tiempo de convivencia con el fallecido. El objetivo general es describir la forma de distribución de la pensión de sobrevivientes que realizan los Jueces, cuando existe convivencia entre un compañero o compañera permanente con sociedad conyugal anterior no disuelta. La estrategia metodológica utilizada para realizar esta investigación, se enmarca en un método inductivo con enfoque descriptivo y cualitativo, que se inscribe en el ámbito del paradigma hermenéutico cuya finalidad es comprender e interpretar, y se utiliza como técnica el análisis documental. La principal conclusión a la que se llegó es la no existencia de unificación de criterios de cada despacho judicial. El juez proyecta su decisión basado en la interpretación que éste le da a la ley, de tal manera que cada despacho tiene sus propios criterios, que en muchas ocasiones no coinciden con las decisiones tomadas en otros despachos.AbstractThis article delves into the survival pension in terms of its distribution and granting requirements, in the manner in which the Labor Courts of the Circuit of Barranquilla-Colombia, apply Article 13 of Law 797 of 2003 that contemplates the effects of the coexistence between a permanent companion with a previous conjugal society not dissolved and the right to receive the pension, indicating that the benefit will be divided among them or them in proportion to the time of coexistence with the deceased. The general objective is to describe the form of distribution of the survivors’ pension that the Judges perform, when there is coexistence between a permanent companion with a previous conjugal society not dissolved. The methodological strategy used to carry out this research is framed by an inductive method with a descriptive and qualitative approach, which falls within the scope of the hermeneutical paradigm whose purpose is to understand and interpret, and documentary analysis is used as a technique. The main conclusion reached is the non-existence of unification of criteria of each judicial office. The judge projects his decision based on the interpretation that this gives to the law, in such a way that each office has its own criteria, which in many cases do not coincide with the decisions taken in other offices.
