El futuro del derecho administrativo en la globalización: entre la americanización y la europeización

Globalisation is becoming juridical globalisation, basically reflecting the parameters of administrative and regulatory Americanisation. The article describes the evolution from the USA individual-centric State towards the administrative, regulatory State. It examines the very different models of security for the USA and Europe. Finally, it shows the two faces of globalisation as Americanisation. Firstly, the exemplary model of the WTO, to whose rules and resolutions the USA submits. Secondly, the temptation of a move towards unilateralism, giving full powers to the president, thereby avoiding judicial control, which was rejected under the jurisprudence of the Supreme Court. La globalización está transformándose en una globalización jurídica y responde fundamentalmente a los parámetros de la americanización administrativa y reguladora. Se expone la evolución del Estado individuo céntrico norteamericano hacia un Estado administrativo y regulador. Se analizan los modelos contrapuestos de seguridad de EE.UU. y Europa. Finalmente, se exponen las dos caras de la globalización como americanización. En primer lugar, el modelo ejemplar de la OMC, en el que EE.UU. se somete a su derecho y a sus resoluciones. En segundo lugar, la tentación de unilateralismo y plenos poderes para el presidente, evadiendo el control judicial, que ha quedado rechazado por la jurisprudencia de la Corte Suprema.
