Tributos sobre transações digitais no Brasil: entre o ideal e o possível

O objetivo desta dissertação é avaliar se o Brasil deve instituir um novo tributo específico para operações digitais no contexto da economia digital. Para tanto, o trabalho foi estruturado em cinco partes. A primeira justifica a importância do tema na atualidade. A segunda cuida da Proposta de Diretiva do Conselho da União Europeia, nº 2018/0073, que estabeleceu as diretrizes gerais para instituição do chamado ISD – Imposto sobre Serviços Digitais, de modo a avaliar seu surgimento, desenvolvimento e utilidade, assim como os principais argumentos favoráveis e contrários à luz do contexto internacional. Na terceira parte, incursiona-se pela realidade brasileira para apresentar o quadro tributário atual no que concerne à tributação da economia digital, com o objetivo de avaliar a real influência desse novo modelo de tributação sobre o sistema normativo brasileiro. A quarta parte trata dos principais desafios, dilemas e ajustes que se fazem necessários no Brasil, no que diz respeito ao tema, e pretende desenvolver, na medida do possível, premissas capazes de nortear a reflexão sobre a qualidade do sistema tributário nacional, para, após, identificar os possíveis aprimoramentos passíveis de implementação no País. Ao fim, pretende-se desenvolver algumas reflexões e considerações críticas sobre os acontecimentos em curso, lançando novo olhar sobre a tributação dos negócios da economia digital no contexto brasileiro. The purpose of this dissertation is to assess whether Brazil should institute a new specific tax for digital transactions in the context of the digital economy. To this end, the paper is structured in five parts. The first justifies the current relevance of the topic. The second part addresses the emergence, development, and usefulness of the Proposal for a Council Directive No. 2018/0073, which established the general guidelines for the creation of the so-called Digital Services Tax (DST). Subsequently, it outlines the main arguments for and against the Proposal in light of the international context. The third part of this paper delves into Brazil's current tax framework regarding taxation of the digital economy, to assess the real influence of this new tax model on the Brazilian regulatory system. The fourth part tackles the main challenges, dilemmas, and adjustments on the subject necessary for Brazil, to develop, as far as possible, premises capable of guiding discussions on the quality of our tax system, and to identify possible improvements to be implemented in the country. The fifth and final part of this research presents critical thoughts and remarks on current events, shedding new light on the taxation of digital economy transactions in Brazil.
