Acceso a la justicia: la experiência de las Casas de Justicia del Departamento Judicial de Azul de la Provincia de Buenos Aires de La República Argentina

El concepto de Acceso a la Justicia ha ido ampliándose y cobrando importancia en América Latina desde fines de los años 80, considerándose un derecho humano fundamental. Su noción abarca los medios alternativos de resolución de conflictos, que resultan de creciente importancia en ciertos contextos y en relación a algunos derechos y determinados grupos sociales. Así es que, en la Argentina se han implementado, a lo largo de estas últimas décadas, programas que buscan efectivizar el acceso a la justicia al ocupar espacios geográficos donde antes el Estado no llegaba. Entre estos programas, se encuentra la experiencia de las 'Defensorías Civiles Descentralizadas en Casas de Justicia' o 'Programa Casas de Justicia' de la Provincia de Buenos Aires. Sin embargo, poco se avanzó en la realización de evaluaciones y/o estudios que permitan entender el impacto que estos tienen. Por lo cual, el objetivo de este trabajo es evaluar si este Programa brinda un efectivo acceso a la justicia a aquellos sectores en situación de vulnerabilidad presentes en las comunidades donde se lo localiza. Esta evaluación se fundamenta en el análisis bibliográfico, documental y a partir de una investigación cualitativa y cuantitativa realizada por medio de entrevistas a operadores clave del Programa. Como consecuencia de este ejercicio, el trabajo revela entre las dificultades del Programa, la acción de coordinar un órgano conformado por esferas de poder diferentes, entendiéndoselas como el Municipio por un lado y el Ministerio Público por el otro. Al mismo tiempo, la investigación manifestó los beneficios del Programa en la aplicación de métodos alternativos de resolución de conflictos en problemáticas de derecho civil y de familia, a través de un abordaje interdisciplinar y de la articulación de esfuerzos con instituciones no gubernamentales, municipales y provinciales. The concept of Access to Justice has been expanding and gaining importance in Latin America since the late 80s, being considered a fundamental human right. Its notion encompasses alternative dispute resolution mechanisms, which are of increasing importance in specific contexts and in relation to some rights and certain social groups. Accordingly, in Argentina there have been implemented, over the last decades, programs that seek to make effective the access to justice, by being located in geographical spaces where the State had notreach before. Among these programs, there is the Program of the 'DefensoríasDescentralizadasen Casas de Justicia' or 'ProgramaCasas de Justicia' of the Province of Buenos Aires. However, little progress was made in the making of evaluations and/or studies that allow the understanding of the impact they have. Therefore, the aim of this work is to evaluate whether this Program provides an effective access to justice to socially vulnerable groups living in the communities where it is located. This evaluation is based on bibliographic and documentary analysis and on a qualitative and quantitative research conducted by means of interviews with key participants of the Program. As a consequence of this exercise, the work exposes among the Program difficulties, the activity of coordinate a body composed of different spheres of power–them being the municipality on the one hand and the public ministry on the other. At the same time, the investigation exhibited the Program benefits in the application of alternative dispute resolution mechanisms in civil and family law issues, by means of an interdisciplinary approach and of the collaboration of efforts with non-governmental, local and regional organizations.
