A regulação a posteriori do regime de bens na união estável com efeitos retroativos: a aplicação do princípio autonomia da vontade existencial

O Direito Civil e, por consequência, o Direito das Famílias, sofreu um processo de mudança hermenêutica tanto por uma nova teoria jurídica da interpretação, quanto por mudanças sociais e legislativas. Este processo colocou o princípio da dignidade humana no centro do ordenamento jurídico, uma vez que é valor constitucional que fundamenta o Estado Democrático de Direito. Cabe, então, avaliar o nível de interferência estatal na esfera individual. Para esta avaliação foram eleitos o conceito de autonomia privada existencial e a teoria do paternalismo libertário. Concluiu-se neste trabalho que a existência de um espaço de autodeterminação em que o indivíduo possa exercer a sua liberdade é necessário para que haja também igualdade. A retroação dos efeitos patrimoniais de contrato de convivência celebrado no âmbito da união estável poderá, em certas hipóteses, satisfazer melhor a igualdade do que a não retroação. Esta análise deve ser feita no caso concreto e limitada por certos critérios para evitar o abuso de direito, o enriquecimento ilícito ou a não aplicação de cláusulas legais que devem ser respeitadas, dentre outros critérios que se descobrirem necessários. No entanto, a possibilidade de retroação deve ser admitida por três motivos principais: a) a existência de um privilégio no casamento em relação à união estável para a fixação do regime de bens e do nível de comunhão de vidas e patrimônio do casal; b) a possibilidade de que o regime legal da comunhão parcial gere enriquecimento ilícito pela impossibilidade do Estado adentrar a esfera íntima e verificar o nível verdadeiro do cumprimento dos requisitos para o estabelecimento da união estável e; c) a existência do direito de não casar. Desta forma, será garantida a proteção à dignidade da pessoa humana e dos princípios que norteiam o Direito das Famílias: a liberdade, a igualdade e a solidariedade. Civil Law and, consequently, Family Law, underwent a process of hermeneutic change both by a new juridical theory of interpretation and by social and legislative changes. This process placed the principle of human dignity at the center of the legal system, since it is the constitutional value that underlies the Democratic Rule of Law. It is then necessary to assess the level of state interference in the individual sphere. For this evaluation were chosen the concept of existential private autonomy and the theory of libertarian paternalism. It was concluded in this work that the existence of a space of self-determination in which the individual can exercise his freedom is necessary so that there is also equality. The retrocession of the patrimonial effects of a cohabitation contract concluded within the framework of a stable union may, in certain cases, better satisfy equality than non-retroaction. This analysis must be done in the concrete case and limited by certain criteria to avoid abuse of law, illicit enrichment or non-application of legal clauses that must be respected, among other criteria that are necessary. However, the possibility of retroaction should be allowed for three main reasons: a) the existence of a privilege in marriage in relation to the stable union for the fixation of the property regime and the level of communion of lives and assets of the couple; b) the possibility that the legal regime of partial communion may generate illicit enrichment because the State can not enter the inner sphere and verify the true level of fulfillment of the requirements for the establishment of a stable union; c) the existence of the right not to marry. In this way, the protection of the dignity of the human person and the principles that guide the Family Law will be guaranteed: freedom, equality and solidarity
