A Propriedade Intelectual no âmbito internacional: análise das indicações geográficas no Acordo Mercosul-União Europeia

Abstract

O presente trabalho objetiva analisar a regulação internacional da propriedade intelectual no mundo pós-globalizado, especialmente no que tange à proteção das indicações geográficas (IGs). Para tanto, apresentará um breve histórico sobre o desenvolvimento do tema e as suas aplicações específicas, tanto dentro da União Europeia, quanto em suas negociações de acordos com terceiros países. No contexto de crescente imposição de restrições aos fluxos comerciais e incertezas no sistema multilateral de comércio, a negociação de acordos preferenciais entre os países se mostra uma estratégia a ser priorizada. Assim, o Acordo Mercosul-União Europeia, assinado em 28 de junho de 2019 e em processo de ratificação, será apresentado com foco nas disposições acerca da propriedade intelectual e indicações geográficas.

This paper aims to analyze the international regulation of intellectual property in the postglobalized world, especially regarding the protection of geographic indications (GIs). Therefore, it will present its historical development and specific application by the European Union, within the bloc and in its relations with third countries. In the context of increasing imposition of restrictions on trade flows and uncertainties in the multilateral trade system, the negotiation of preferential agreements between countries is a strategy to be prioritized. Thus, the Mercosur-European Union Agreement, signed on June 28, 2019 and in the process of ratification, will be presented with a focus on provisions on intellectual property and geographical indications.
