Um diálogo com os litigantes da violência policial na CIDH

A dissertação buscou compreender o papel da Comissão Interamericana de Direitos Humanos (CIDH) e do Sistema Interamericano de Direitos Humanos (SIDH) no litígio da violência policial brasileira, a partir da perspectiva dos litigantes. Insere-se em um contexto em que há a persistência da violência policial, principalmente contra a população negra e periférica, impactando negativamente pessoas em situação de vulnerabilidade e constituindo graves violações de Direitos Humanos. Ademais, os órgãos judiciais e políticas públicas brasileiros falham em solucionar o problema e perpetuam a impunidade, conforme retratado no relatório desenvolvido pela CIDH em 2021. Introduz-se o trabalho com questões gerais de Direitos Humanos e da violência policial, seguida pela explicação metodológica que norteou a pesquisa. A partir disso, é trabalhada a questão da violência policial no Brasil, abordando o viés autoritário não combatido com a redemocratização, a desigualdade e a inefetividade do Estado de Direito. No capítulo 3, tem-se a conceituação do Direito Internacional dos Direitos Humanos, do Sistema Interamericano de Direitos Humanos e a litigância estratégica, de modo que o capítulo seguinte traz dados quantitativos sobre a CIDH, os litigantes e os casos de violência policial encontrados. Em seguida, o capítulo 5 expõe os achados de pesquisa advindos das entrevistas com os atores envolvidos nos casos e o cruzamento com os dados teóricos anteriormente expostos. Assim, são evidenciados os pontos de vista de membros da sociedade civil, de movimentos sociais e Defensores Públicos sobre a temática, de forma a compreender essa atuação, a importância do SIDH e da jurisdição internacional, as respostas da CIDH como forma de pressão e mobilização, os problemas e oportunidades de fortalecimento, como ocorre a litigância estratégica no tema da violência policial e os motivos pelos quais utilizar o SIDH. Dessa forma, foi possível entender a contribuição da CIDH para a ampliação do respeito aos Direitos Humanos no Brasil. The dissertation sought to understand the role of the Inter-American Commission on Human Rights (IACHR) and the Inter-American System of Human Rights (IAHRS) on the litigation of Brazilian police violence, from the perspective of the litigants. It is part of a context in which there is a persistence of police violence, mainly against the black and peripheral population, negatively impacting people in vulnerable situations and constituting serious violations of Human Rights. Furthermore, Brazilian judicial bodies and public policies fail to solve the problem, and perpetuate impunity, as portrayed in the report developed by the IACHR in 2021. The work starts with general issues of Human Rights and police violence, followed by the methodological explanation that guided the research. From this, the issue of police violence in Brazil is addressed, addressing the authoritarian bias not fought with redemocratization, inequality and the ineffectiveness of the Rule of Law. In chapter 3, there is the conceptualization of International Human Rights Law, the Inter-American System of Human Rights and strategic litigation, so that the following chapter brings quantitative data on the IACHR, the litigants and the cases of police violence found. Then, chapter 5 exposes the research findings from the interviews with the actors involved in the cases and the crossing with the theoretical data previously exposed. Thus, the points of view of members of civil society, social movements and Public Defenders on the subject are highlighted, in order to understand this action, the importance of the IAHRS and international jurisdiction, the responses of the IACHR as a form of pressure and mobilization, the problems and opportunities for strengthening, how strategic litigation on the issue of police violence occurs and the reasons for using the IAHRS. In this way, it was possible to understand the contribution of the IACHR to the expansion of respect for Human Rights in Brazil.
