El propósito de este trabajo es determinar si es posible anticipar pruebas en materia laboral de acuerdo con la estructura que presenta el procedimiento en la Ley Orgánica Procesal del Trabajo, a pesar de no aparecer expresamente prevista esa posibilidad en la Ley, señalándose el juez competente a tales fines y el procedimiento a seguir para la practica de la mencionada prueba. Para ello se establecieron los siguientes objetivos específicos: Determinar si sería contrario al principio de inmediación permitir la producción de pruebas anticipadas con fines probatorios que no hubieren sido promovidas en la audiencia preliminar de conformidad con lo previsto en la Ley Orgánica Procesal del Trabajo venezolana. Explicar por ante cuál juez, el de sustanciación, mediación y ejecución, o el de juicio, deberían ser practicadas las pruebas anticipadas con fines probatorios en el proceso laboral venezolano. Identificar el procedimiento a través del cual sería posible anticipar pruebas en el procedimiento laboral venezolano. Establecer cómo podría garantizarse el control probatorio de esa prueba por la parte contraria en el proceso laboral venezolano. Las interrogantes que la investigación se planteó fueron las siguientes: ¿Es posible anticipar pruebas de acuerdo con la estructura que presenta el procedimiento laboral venezolano previsto en la Ley Orgánica Procesal del Trabajo? ¿Sería contrario al principio de inmediación permitir la producción de pruebas anticipadas con fines probatorios que no hubieren sido promovidas en la audiencia preliminar de conformidad con lo previsto en la ley Orgánica Procesal del Trabajo? ¿Por ante cuál juez, el de sustanciación, mediación y ejecución o el de juicio, deberían ser practicadas las pruebas anticipadas con fines probatorios en el proceso laboral venezolano? ¿A través de cual procedimiento sería posible anticipar pruebas en el procedimiento laboral venezolano?¿Cómo podría garantizarse el control probatorio de esa prueba por la parte contraria en el proceso laboral venezolano? Se partió primordialmente de métodos cualitativos, como el documental, por lo que constituirá una investigación analítica y de desarrollo conceptual, con apoyo en una amplia revisión bibliográfica. Se obtuvo como resultado que es posible anticipar pruebas en materia laboral, considerándose como competente a tales fines al Juez de sustanciación, mediación y ejecución, conforme al procedimiento que establezca el juez en base a los poderes de oficio que en materia probatoria le otorga la ley, y cuya valoración será atribuida por el juez de juicio. The purpose of this work is to determine if it is possible to anticipate evidence in labor matters according to the structure presented by the procedure in the Organic Labor Procedural Law, despite that it isn´t expressly foreseeing this possibility in the Law, pointing out the competent judge to Such purposes and the procedure to be followed for the practice of the mentioned test. The questions raised by the investigation were the following: Is it possible to anticipate evidence according to the structure of the Venezuelan labor procedure provided for in the Organic Law of Labor Procedure? Would it be contrary to the principle of immediacy to allow the production of evidence for evidence that has not been promoted at the preliminary hearing in accordance with the provisions of the Organic Law of Labor Procedure? Before which judge, that of substantiation, mediation and enforcement or trial, should be practiced the anticipated tests for evidentiary purposes in the Venezuelan labor process? Through which procedure would it be possible to anticipate evidence in the Venezuelan labor procedure? How could the evidence control of that evidence by the opposing party be guaranteed in the Venezuelan labor process? It was based primarily on qualitative methods, such as the documentary, so it will constitute an analytical research and conceptual development, with support in a wide bibliographic review. It was obtained as a result that it is possible to anticipate evidence in labor matters, being considered as competent for such purposes to the Judge of substantiation, mediation and execution, according to the procedure that establishes the judge based on the powers of ex officio that in probative matter granted by law, And whose assessment will be attributed by the trial judge.
