| dc.description | El presente trabajo fue inspirado por una serie de denuncias de trabajadores que temían por sus vidas en el ejercicio de la radiología, las cuales recibí en mi calidad de periodista, por lo que el propósito de esta investigación es demostrar la violación de los derechos humanos en los hospitales públicos del área Metropolitana de Caracas, a causa del incumplimiento de las normas de seguridad y protección radiológica en los Servicios de Radiología. El tema escogido para la investigación representó varias complejidades por la necesidad de explorar los diferentes centros de salud a los fines de comprobar la violación de los derechos de la salud y la vida de trabajadores en los servicios de radiología de los hospitales públicos frente a la rotunda negativa de la directiva de los diversos hospitales en dejarnos entrar para realizar las indagaciones. Sin embargo, al margen de dichas prohibiciones, logramos ingresar a los centros de salud alcanzado establecer los factores esenciales que incidían e inciden directamente en las violaciones de los derechos humanos. Por el área en que se desarrollaron las indagaciones para el presente trabajo la metodología utilizada fue la cualitativa. El nivel de análisis de estudio fue adquirido a través de la investigación documental y de campo. La primera mediante la consulta de textos, jurisprudencias, leyes internas, Tratados Internacionales y la prensa. En cuanto a la investigación de campo se realizaron entrevistas a especialistas en salud ocupacional, a varios trabajadores de los Servicios de Radiología, quiénes pidieron mantener el anonimato para evitar ser destituidos del cargo, miembros de gremios que agrupan trabajadores de los Servicios de Radiología y representantes de organismos multilaterales. Las estrategias de investigación también se basaron en la comparación de los diferentes documentos previos, escritos por especialistas en el área de medicina para poder determinar los efectos biológicos de la radiación ionizante, doctrinas en derecho laboral y de seguridad e investigaciones de organismos multilaterales para poder determinar la existencia o no de violaciones de los Derechos Humanos. En cuanto a las entrevistas realizadas a especialistas y trabajadores nos permitió conocer las enfermedades ocupacionales de algunos trabajadores, entre otras trasgresiones. Para concluir en la presente indagación logramos constatar el incumplimiento de normas de seguridad y protección radiológica en los hospitales públicos y la omisión del Estado deudor por inobservancia de su responsabilidad en la vigilancia y control como garantía de los derechos a la salud y la vida de los trabajadores, en nuestro caso en los Servicios de Radiología; la falta de sanciones individuales para los funcionarios públicos que por acción o por omisión colocan en riesgo a éstos trabajadores, la negativa de entes públicos en indemnizar a las víctimas, la criminalización contra los trabajadores que denuncian el incumplimiento de las normas, todo lo cual induce a una total impunidad y en consecuencia convirtiéndose el Estado venezolano en violador de los derechos humanos. | |
| dc.description | The present work it was inspired by a series of workers' denunciations that were afraid for his lives in the exercise of the radiology, which I received in my journalist quality, for what the intention of this investigation is to demonstrate the violation of the human rights in the public hospitals of the Metropolitan area of Caracas, because of the breach of the safety procedure and radiological protection in the Services of Radiology. The topic chosen for the investigation represented several complexities for the need to explore the different centers of health to the ends of verifying the violation of the rights of the health and the workers' life in the services of radiology of the public hospitals opposite to the negative rotunda of the board of the diverse hospitals in leaving ourselves to enter to realize the investigations. Nevertheless, to the margin of the above mentioned prohibitions, we manage to enter to the centers of health reached to establish the essential factors that were affecting and they affect directly in the violations of the human rights. For the area in which the investigations developed for the present work the used methodology was the qualitative one. The level of analysis of study was acquired across the documentary investigation and field. The first one by means of the consultation of texts, jurisprudences, internal laws, International Agreements and the press. As for the field investigation they were realized you interview specialists in occupational health, to several workers of the Services of Radiology, who asked to support the anonymity to avoid to be destroyed of the post, members of unions that there group workers of the Services of Radiology and representatives of multilateral organisms. The strategies of investigation also were based on the comparison of the different previous documents, written by specialists on the area of medicine to be able to determine the biological effects of the radiation ionizante, doctrines in labor law and of safety and investigations of multilateral organisms to be able to determine the existence or not of violations of the Human rights. As for the interviews realized to specialists and workers it allowed us to know the occupational diseases of some workers, between other transgressions. To conclude in the present investigation we manage to state the breach of safety procedure and radiological protection in the public hospitals and the omission of the debit State for nonobservance of his responsibility in the vigilance and control as guarantee of the rights to the health and the life of the workers, in our case in the Services of Radiology; The lack of individual sanctions for the government employees who for action or for omission place in risk hard-working these, the denial of public entities in indemnifying the victims, the criminalización against the workers who denounce the breach of the procedure, everything which induces to a total impunity and in consequence turning the Venezuelan State into rapist of the human rights.
